Terms of Service

Last updated: 2025-03-20

Version: v1.0.1

Effective date: 2025-03-20

These Terms of Service (the “Agreement”) are a legal agreement between you (the “User” or “you”) and AI BrandRank Institute (AIBRI) (the “Institute” or “we”) regarding your access to aibrandrank.org (the “Site”) and your use of audit reports, index data, and related services published by AIBRI.

By entering the Site or citing any content published on it, you acknowledge that you have read, understood, and agreed to be bound by all terms of this Agreement.

1. Institutional Nature and Service Scope

  • AIBRI is an independent third-party research institution focused on AI model brand-recognition auditing.
  • All content on the Site, including but not limited to the AIRI Recognition Index, audit bulletins, competitor comparison analyses, and Evidence Vault descriptions, is provided solely for academic research, market reference, and media reporting.
  • Non-commercial advisory statement: no conclusion published by AIBRI constitutes legal advice, investment advice, public-relations strategy advice, or any form of professional endorsement.

2. Intellectual Property and License

  • Ownership: AIBRI holds full intellectual-property rights to all original Site content, including AIRI algorithm logic, audit methodology, report text, charts, institutional marks, and visual design.
  • Citation license: when media, academic institutions, or individuals cite AIBRI data for non-commercial use, they must prominently attribute “AI BrandRank Institute (AIBRI)” and provide a link to the original report.
  • Prohibited acts: without prior written consent, it is strictly prohibited to mass-scrape Site audit data with automated tools, resell Site reports commercially or use them as core paid-consulting materials, or alter audit conclusions to mislead the public.

3. Evidence Links and Third-Party Content

  • AIBRI audit conclusions rely heavily on original shared-session links generated by third-party AI providers (such as OpenAI, Anthropic, and Google).
  • Content in those evidence links is generated in real time by third-party AI models. AIBRI only observes, records, and audits such output, and assumes no responsibility for its authenticity, legality, or accuracy.
  • If evidence becomes inaccessible because a third-party provider deletes links or discontinues service, AIBRI will make reasonable efforts to provide internal backup screenshots but does not guarantee perpetual evidence-chain availability.

4. Disclaimer

  • AI randomness risk: AIBRI captures observational samples under specific times and environments, which do not represent constant model behavior in all scenarios.
  • Decision risk: any commercial decision made by brands or investors based on AIBRI reports is at their own risk. AIBRI is not liable for any direct, indirect, incidental, special, or consequential damages.
  • Hallucination risk: AI models may generate false information via hallucinations. AIBRI’s role is to disclose such risks and their potential impact on brand cognition, not to certify false information as fact.

5. Prohibited Commercial Interference

  • AIBRI strictly prohibits all forms of commercial manipulation. The Institute reserves the right to pursue legal action against attempts to interfere with rankings, tamper with evidence archives through vulnerabilities, or intrude into backend systems.
  • No organization or individual may use AIBRI’s name for false promotion or fraudulent activities.

6. Governing Law and Dispute Resolution

  • This Agreement, including its formation, performance, interpretation, and dispute resolution, is governed by the laws of the Kingdom of Spain and applicable EU laws.
  • Any dispute concerning this Agreement shall first be resolved through friendly consultation; failing that, it shall be submitted to a court with jurisdiction in Madrid.

7. Amendment and Termination

AIBRI may amend this Agreement at any time based on technological evolution or regulatory requirements. Revised terms take effect automatically upon publication on the Site. Continued use of the Site after publication constitutes acceptance of the revised terms.
